2. Agreement to These Terms

By booking, hiring, purchasing, collecting, or using any equipment supplied by us, you agree to be bound by these Terms.

If you do not agree, you must not proceed with the booking or use of the equipment.


3. Rental Equipment

We hire surfboards and related equipment, including but not limited to:

  • Longboards, shortboards, softboards, mid-length and custom boards
  • Leashes, fins, and surfboard accessories

Rental periods may range from one day to an ongoing or extended period, as selected at the time of booking.


4. Pickup, Lockers & Delivery

4.1 Self-Service Locker Pickup & Return

  • 24/7 locker pickup and return is available from:
    60 Hastings St, Noosa Heads QLD 4567
  • A minimum 12-hour advance booking is required.
  • Responsibility for the equipment passes to you immediately once the locker opens, regardless of whether you remove the equipment.
  • You are responsible for:
    • Safeguarding locker access codes
    • Ensuring only authorised persons access the locker
    • Any loss, theft, or damage arising from misuse or unauthorised access

We are not responsible for loss or damage caused by incorrect locker use or third-party access.


4.2 Delivery

  • Free delivery is available within 50 km of the shop.
  • Delivery outside this area may be available by agreement.
  • Delivery times are estimates only and not guaranteed.


5. Rental Fees & Payments

  • Full payment is required before collection or delivery.
  • Accepted payment methods include:
    • Online card payment
    • In-store card terminal
    • Cash
  • No security bond is required unless otherwise agreed.


6. Damage Waiver (10%)

A 10% damage waiver is included in the rental price.

The damage waiver:

  • Covers accidental damage only
  • Is not insurance

The damage waiver does not cover:

  • Loss or theft
  • Negligence, misuse, or reckless behaviour
  • Total destruction of equipment
  • Failure to follow reasonable care instructions

This waiver does not limit or exclude your rights under the Australian Consumer Law.


7. Responsibility for Loss or Damage

You are responsible for the equipment from the time it is collected, delivered, or accessed from a locker until it is returned and checked by us.

You are liable for:

  • Loss or theft
  • Negligent or reckless damage
  • Total destruction
  • Damage beyond normal wear and tear

Where applicable, we may charge:

  • The reasonable cost of repair, or
  • The reasonable replacement value (market value),
    whichever is appropriate.


8. Authority to Charge Payment Method

If equipment is lost, stolen, destroyed, or damaged beyond the scope of the damage waiver, you authorise us to charge the payment method used for the booking for reasonable repair or replacement costs.

We will make reasonable attempts to contact you before processing any such charge.


9. Safety, Use & Condition

You confirm that:

  • You are competent and physically capable of using the equipment
  • The equipment is suitable and in acceptable condition at pickup or delivery
  • You will use the equipment only for its intended purpose
  • You will not use the equipment while under the influence of drugs or alcohol


10. Recreational Activity Risk Warning (Queensland)

Surfing is a dangerous recreational activity under the Civil Liability Act 2003 (Qld).

You acknowledge that:

  • Surfing involves inherent and obvious risks
  • Conditions may change without warning
  • Injury, serious harm, or death may occur

By hiring and using the equipment, you voluntarily accept these risks.

To the maximum extent permitted by law, we are not liable for loss, damage, or injury arising from participation in a recreational activity.


11. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees or rights under the Australian Consumer Law.


12. Cancellations & Refunds

  • 24 hours or more before rental start:
    Refund available, less non-refundable payment processing fees.
  • Less than 24 hours’ notice:
    No refund, but the booking may be transferred to another rental period (subject to availability).

Changes or cancellations must be requested by phone or WhatsApp.


13. Sales of Goods

Sales of surfboards and accessories are subject to:

  • Stock availability
  • Australian Consumer Law guarantees
  • Delivery or pickup arrangements agreed at purchase


14. Privacy

Personal information is handled in accordance with our Privacy Policy, available on our website.


15. Governing Law

These Terms are governed by the laws of Queensland, Australia.
